General Terms & Conditions
These Terms and Conditions govern your use of the Company website (the “Company Site”) and your relationship with Pullingers (the “Company”, “we” or “us”). Please read them carefully as they affect your rights and liabilities under the law. If you do not agree to these Terms and Conditions, please do not register for or use the Company Site. 1 Use of the Company Site
1.1 The Company Site is provided to you for your personal use subject to these Terms and Conditions. By using the Company Site you agree to be bound by these Terms and Conditions.
2.1 We may update these Terms and Conditions from time to time for legal or regulatory reasons or to allow the proper operation of the Company Site. Any changes will be notified via a suitable announcement on the Company Site. The changes will apply to the use of the Company Site after we have given notice. If you do not wish to accept the new Terms and Conditions you should not continue to use the Company Site. If you continue to use the Company Site after the date on which the change comes into effect, your use of the Company Site indicates your agreement to be bound by the new Terms and Conditions.
3.1 To order goods on the Company Site you must be over eighteen years of age.
4.1 Your order is an offer to buy from us. There will be no contract of any kind between you and us unless and until we actually despatch the goods to you. At any point up until then we may decline to supply the goods to you without giving any reason. In those circumstances you would be given a full refund. At the moment when the goods are despatched a contract will be made between you and us.
4.2 The prices payable for the items that you order are clearly set out on the Company Site. If, by mistake, we have under-priced an item, we will not be liable to supply that item to you at the stated price provided that we notify you before we dispatch the item concerned.
4.3 All prices are expressed inclusive of any VAT payable unless otherwise stated. If ordering from USA, Canada, Australia, New Zealand, Switzerland, Norway or the Channel Islands the VAT will automatically be deducted from the price of that product at the point of entering your details at the Checkout (Please make sure that you select the relevant country at Checkout).
4.4 Your credit / debit card details will be encrypted to minimise the possibility of unauthorised access or disclosure. Authority for payment must be given at the time of placing your order.
4.5 If items are out of stock you will be notified by email and given the option to request a full refund which would have the effect of cancelling your order.
4.6 We will charge payment to your card only once your order is ready to be dispatched (unless you are paying through PayPal). If your order is being part shipped we will only charge you for the goods that are being dispatched at that time. When the remainder of your goods are ready for dispatch your card will be charged for the remaining balance.
5.1 If for any reason beyond our reasonable control, we are unable to supply a particular item, we will not be liable to you except to ensure that you are not charged for that item.
6 Reserve & Collect In Store
6.1 The Reserve & Collect facility allows you to reserve your items for colection at one of our stores. Payment for reserved items is taken in full through our website prior to collection. There are NO Delivery charges and no waiting for the courier and you still get the convenience and the ease of shopping online! 7.1 Delivery will be made to the address specified by you on the completed order form. Please ensure that you provide the correct delivery address. You, the customer, will be responsible for any incorrect or incomplete address leading to the failure of delivery and may be charged for redelivery.
7.2 We will deliver your order to the main entrance of the delivery address.
7.3 Standard delivery will take approximately 2-5 days for Mainland UK and up to 7 working days for delivery to EU & International Countries. A signature may be required on delivery by an adult aged 18 years or over. Whilst we make every effort to deliver all your goods in the agreed time, we will not be liable if we fail to do so in part or in full due to circumstances beyond our control.
7.4 Most orders are delivered by courier and are insured by us against loss or damage until signed for by you. It is your responsibility to inspect the delivery for external damage before you sign for delivery. If the outer box is badly damaged please make a note of this on the delivery note and refuse to accept delivery. Missing or damaged items must be notified to us in writing within 24 hours of delivery.
7.5 Some Products are classed as over-sized items, including large Canvases and Studio Easels. These products can only be delivered within the UK on a Standard Delivery Service. Please note that some larger items may incur a delivery surcharge or only be available for store collection. If this is the case, Pullingers will notify you first of any extra costs before processing & proceeding with your order.
7.6 Prohibited Items - Solvent based products, oil based products, flammable liquids and aerosols, including spray paints, can only be shipped within the UK.
7.7 International Deliveries - VAT will be removed from any order total for international destinations. However, the recipient is wholly responsible for the payment of any import duty and taxes and it is their responsibility to find out if these will apply to the goods within their order. Any returned shipments refused at entry will have the full cost of shipping deducted from any refund.
7.8 Delivery to areas outside Mainland UK is calculated on the size and weight of the items ordered at the Checkout once you have entered your shipping address.
7.9 Free Delivery on orders over £45 is applicable to Mainland UK deliveries only. This excludes the following: The Highlands and Islands of Scotland - postcodes IV, HS, KA27-28, KW, PA20-49, PA60-78, PH17-26, PH30-44, PH49-50, ZE, The Isle Of Wight (PO30-41), Northern Ireland (BT), Isle Of Man (IM), The Isles Of Scilly (TR21-25) & The Channel Islands (postcodes JE & GY). Please note that Free Delivery to UK Mainland may also exclude some larger items such as Studio Easels.

8 Returns of non-perishable items
8.1 We hope you will be happy with your purchase. However, should you feel it necessary to return a non-perishable item, you may cancel the contract for its purchase by contacting firstname.lastname@example.org specifying the reason that the item is being returned within seven working days of delivery of the items to you. You will then be issued with a returns number. You should then return the relevant item to us in secure packaging to 18 High Street, Epsom, Surrey KT19 8AH, UK.
8.2 You will be responsible for the cost of returning any item to us unless the item is defective or we have delivered the item to you in error or as a substitute or you wish to return the whole complete order within 7 working days of receiving it. The item should be returned to us unused. If we do not receive the item back from you we may arrange for collection of the item from you at your cost.
8.3 When we receive the returned item, we will refund the price paid by you for that item or at your request if the item is defective will repair the item or supply you with a replacement item. We will give a full refund including the intial delivery charge if unwanted goods are returned within seven days.
9 Cancellation and changes prior to delivery
9.1 You can cancel or change any of your current orders prior to dispatch by contacting email@example.com
10 Intellectual property
10.1 The content of the Company Site is protected by copyright, trade marks, database right and other intellectual property rights. You may retrieve and display the content of the Company Site on a computer screen, store such content in electronic form on disk (but not any server or other storage device connected to a network) or print one copy of such content for your own personal, non-commercial use, provided you keep intact all and any copyright and proprietary notices. You may not otherwise reproduce, modify, copy or distribute or use for commercial purposes any of the materials or content on the Company Site without written permission from the Company.
11 Your use of the Company Site
11.1 You may not use the Company Site for any of the following purposes:
11.1.1 disseminating any unlawful, harassing, libellous, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable material or otherwise breaching any laws;
11.1.2 transmitting material that encourages conduct that constitutes a criminal offence, or otherwise breaches any applicable laws, regulations or code of practice;
11.1.3 interfering with any other person’s use or enjoyment of the Company Site; or
11.1.4 making, transmitting or storing electronic copies of materials protected by copyright without the permission of the owner.
11.2 You will be responsible for our losses and costs resulting from your breach of this clause 10.
12 Availability of the Company Site
12.1 Although we aim to offer you the best service possible, we make no promise that the services at the Company Site will meet your requirements. We cannot guarantee that the services will be fault-free. If a fault occurs with the Company Site you should report it to firstname.lastname@example.org and we will attempt to correct the fault as soon as we reasonably can.
12.2 Your access to the Company Site may be occasionally restricted to allow for repairs, maintenance or the introduction of new facilities or services. We will attempt to restore the service as soon as we reasonably can.
13 The Company’s liability
13.1 The Company Site provides content from other Internet sites or resources and while the Company tries to ensure that material included on the Company Site is correct, reputable and of high quality, it does not make any warranties or guarantees in relation to that content. If the Company is informed of any inaccuracies in the material on the Site we will attempt to correct the inaccuracies as soon as we reasonably can.
13.2 If we are in breach of these Terms & Conditions, we will only be responsible for any losses that you suffer as a result to the extent that they are a foreseeable consequence to both of us at the time you use the Company Site. Our liability shall not in any event include business losses such as lost data, lost profits or business interruption.
13.3 This clause 12 shall not limit or affect our liability resulting from any products sold through the Company Site being found to be unsafe or if something we do negligently causes death or personal injury.
14 Third Party Websites
14.1 As a convenience to customers, the Company Site includes links to other web sites or material which are beyond its control. The Company is not responsible for content on any site outside the Company Site.
15 Advertising and Sponsorship
15.1 Part of the Company Site may contain advertising and sponsorship. Advertisers and sponsors are responsible for ensuring that material submitted for inclusion on the Company Site complies with relevant laws and codes. We will not be responsible to you for any error or inaccuracy in advertising and sponsorship material.
16 Applicable Law
16.1 These Terms and Conditions will be subject to the laws of England and Wales. We will try to solve any disagreements quickly and efficiently. If you are not happy with the way we deal with any disagreement and you want to take court proceedings, you must do so within the United Kingdom.
17 International Use
17.1 We make no promise that materials on the Company Site are appropriate or available for use in locations outside the United Kingdom, and accessing the Company Site from territories where its contents are illegal or unlawful is prohibited. If you choose to access this site from locations outside the United Kingdom, you do so on your own initiative and are responsible for compliance with local laws.
18.1 You may not transfer any of your rights under these Terms and Conditions to any other person. We may transfer our rights under these Terms and Conditions to another business where we reasonably believe your rights will not be affected.
18.2 We do not disclose your information to third parties. Cookies and server sessions are used on this shopping site.
18.3 If you breach these Terms and Conditions and the Company chooses to ignore this, the Company will still be entitled to use its rights and remedies at a later date or in any other situation where you breach the Terms and Conditions.
18.4 The Company shall not be responsible for any breach of these Terms and Conditions caused by circumstances beyond its reasonable control.
